Privacy Statement Application Procedures Omega Metals, LLC

This privacy statement applies to all application procedures of Omega Metals, LLC (Omega Metals), the controller. This privacy statement describes which personal data Omega Metals collects from applicants, how this data is processed and for what purposes.
 
This privacy statement is in accordance with the General Data Protection Regulation (GDPR).

Personal data

Omega Metals collects and processes personal data in accordance with the GDPR. This means that Omega Metals is responsible for handling personal data with care.

The personal data that Omega Metals collects from the applicant is the data that the applicant himself provides to Omega Metals by means of a CV, letter of application or other correspondence.

Omega Metals also collects and processes applicant data by means of personal contacts, telephone conversations and/or e-mail.

The data of applicants that are stored in the database are: contact details of the applicant (name and address, email address, gender, language), education of the applicant, (training, courses, etc.) employment history (former employers, references, etc.).

In addition, a social media check can also be part of the application procedure. Omega Metals will process this data in accordance with the AVG.

The applicant agrees to the further processing of personal data within Omega Metals.

Purposes

The collection and processing of personal data is necessary for the execution of the application procedure.

The data will only be used for the procedure for which the applicant registers.

Share with third parties

Personal data of the applicant will only be shared with the HRM department of Omega Metals and with the application committee and will not be passed on to third parties. If there are other leads for other vacancies, the applicant will first be asked for permission. In addition, the application committee may also consist of third parties, being recruitment and selection agencies
engaged by Omega Metals.

Omega Metals has concluded agreements with external parties that process data from Omega Metals to ensure that they also process according to the guidelines of the GDPR.

Storage and deletion of personal data

The applicant's data is stored per vacancy as long as the recruitment and selection procedure is ongoing.

After the recruitment and selection procedure, the data of applicants will be stored for a maximum of 1 year. Dutch legislation (regarding data retention) is always consulted and complied with. After the period in which the applicant's data is stored has expired, it will be
completely removed from the Omega Metals system.

Protection of personal data

The applicant's data is protected against misuse and unauthorized access.

The applicant's data will be treated confidentially.

Right of access/adjustment

The applicant has the right to request which data is stored about him or her. This can be done via the website of Omega Metals (www.storkimm.com). The applicant must indicate what he/she thinks should be done with the data. Omega Metals will confirm the request within 5 working days and indicate how and within what period the request will be met.

In addition to inspection, the applicant also has the right to delete or change his/her data.

If and insofar as applicable, the applicant can always withdraw his/her consent to the processing of the personal data.

Transferability

The applicant has the right to have his/her personal data transferred to third parties.

This can be done via the Omega Metals website. The applicant must indicate what he/she thinks should be done with the data. Omega Metals will confirm the request within 5 working days and indicate how and within what period the request will be met.

References

The applicant may only provide personal data of any references if the sponsor has given explicit permission for this. The responsibility for this rests with the applicant.

Objection

If the applicant does not agree with the processing of his/her personal data, the applicant has the right to object to Omega Metals via the Omega Metals website.

In addition, the applicant also has the right to submit a complaint to the Dutch Data Protection Authority.

Data breach notification obligation

A data breach is a breach of the security of personal data. Despite the fact that the applicant's data is processed with great care, a data leak can occur. If this happens, Omega Metals will inform the applicant accordingly. If there is a high risk for the applicant's rights and freedoms, the data breach will be reported to the Dutch Data Protection Authority.

In the event of a data breach, the applicant will receive the following information:

  • Scope of the data breach
  • Likely consequences of the data breach
  • Measures to prevent a similar data breach in the future
  • Employment agencies etc.

If the applicant is nominated by a third party, Omega Metals assumes that the applicant is aware of this and has given permission for the processing and distribution of his/her personal data. The responsibility of a lawful processing of personal data by the third party rests entirely with the third party.
